These Terms and Conditions (“Terms”) govern your access to and use of the MotoGuru website, mobile application, and related services (collectively, the “Platform”), operated by MotoGuru Technologies Private Limited (“MotoGuru”, “Company”, “we”, “us”, or “our”).

By accessing, browsing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform or its services.

These Terms constitute a legally binding agreement under the laws of India.

1. Nature of the Platform

MotoGuru is a technology-enabled platform that helps car owners discover, compare, and connect with verified independent garages for vehicle servicing and repairs.

MotoGuru:

  • Does not own or operate any garages
  • Does not directly provide mechanical, repair, or maintenance services
  • Acts only as a facilitator between users and third-party service providers

All services are performed solely by independent garages.

2. Eligibility

You must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Comply with applicable Indian laws

If you are using MotoGuru on behalf of an organization, you confirm you are authorized to do so.

3. User Account & Responsibilities

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Be responsible for all activities under your account

MotoGuru is not liable for unauthorized account usage resulting from your failure to secure your credentials.

4. Services Offered

Through the Platform, users may:

  • Browse verified garages
  • Compare pricing, ratings, distance, and service inclusions
  • Request estimates and track service progress
  • Receive updates related to services

All prices shown are indicative estimates, unless explicitly confirmed by the garage.

5. Estimates & Additional Work

  • Initial costs shared are estimates based on provided information
  • If additional issues are identified, a revised estimate must be approved by you before work continues
  • MotoGuru does not force service decisions

Final costs are determined by the garage based on actual work performed.

6. Payments

  • Payments (if applicable) may be collected directly by garages or via third-party payment processors
  • MotoGuru may act as a limited payment facilitator where enabled
  • All applicable taxes are payable by the user

MotoGuru is not responsible for payment disputes between users and garages, but may assist in resolution.

7. Cancellations & Refunds

  • Once a service is accepted by the garage and work has begun, cancellations may not be permitted
  • Refunds, if any, are subject to the garage’s policy and service status
  • MotoGuru does not guarantee refunds but will support dispute resolution where applicable

8. Pick-Up & Drop Services

Where offered:

  • Pick-up and drop are provided by garages, not MotoGuru
  • Availability, distance limits, and charges vary by garage

MotoGuru is not liable for delays or damages unless caused by platform negligence.

9. User Conduct

You agree not to:

  • Submit false or misleading information
  • Post defamatory, abusive, illegal, or misleading content
  • Manipulate ratings or reviews
  • Misuse the Platform for unlawful or commercial exploitation
  • Interfere with platform security or operations

Violation may result in account suspension or termination.

10. Reviews & User Content

By submitting reviews, ratings, or feedback:

  • You confirm the content is truthful and based on genuine experience
  • You grant MotoGuru a non-exclusive, royalty-free license to use such content
  • MotoGuru may moderate or remove content violating policies

MotoGuru is not responsible for opinions expressed by users or garages.

11. Intellectual Property Rights

All content on the Platform, including logos, software, designs, text, and graphics, is owned by or licensed to MotoGuru.

You may not:

  • Copy, reproduce, distribute, or exploit content commercially
  • Use MotoGuru trademarks without written permission
  • Limited, revocable access is granted for personal, non-commercial use only.

12. Limitation of Liability

MotoGuru shall not be liable for:

  • Quality of services provided by garages
  • Delays, failures, or inaccuracies by third-party providers
  • Indirect, incidental, or consequential damages

Services are provided on an “as-is” and “as-available” basis.

13. Indemnification

You agree to indemnify and hold harmless MotoGuru, its directors, employees, and affiliates from claims arising due to:

  • Your misuse of the Platform
  • Violation of these Terms
  • Breach of applicable laws

14. Termination

MotoGuru may suspend or terminate your access:

  • For violation of these Terms
  • For fraudulent or unlawful activity
  • At its discretion for platform safety

Upon termination, your access rights cease immediately.

15. Modifications to Terms

MotoGuru reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform. Continued use constitutes acceptance of revisions.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India.
Courts located in India shall have exclusive jurisdiction.
